When travelling by sea or inland waterway (cruise, ferry or boat trip) , you have the following rights in accordance with the European regulation CE 1177/2010:
If your cruise, ferry or boat trip is cancelled or delayed, you have a right to claim compensation , assistance and where applicable to choose between a refund or rerouting.
The European regulation n°1177/2010 applies in 2 scenarios:
In case of cancellation or a delay in departure of more than 90 minutes, the shipping company has to offer assistance. This entitlement to assistance applies for travel by cruise ship, ferry service or boat trip.
The company should offer to cover the costs of your refreshments and food expenses during the waiting time.
If your departure is postponed to the following day, the company has an obligation to offer you a hotel night or to foresee accommodation on board, up to a limit of 80 euros per night and per passenger, and for upto a maximum of 3 nights.
If you have to spend a night in a hotel while waiting to be rerouted, the company must pay your transport costs from the port to the place of your accommodation and back.
In the event of cancellation or a delay to departure of more than 90 minutes, you have the choice between a refund or rerouting.
In the event of cancellation or a delay to departure of more than 90 minutes, you have the right to refuse the departure and to be refunded.
The company will have to refund you the full price of your ticket and, if applicable, will have to repatriate you for free and as soon as possible to your initial point of departure.
The refund must be made within 7 days, and the shipping company cannot force you to accept vouchers.
This option only applies to ferry or boat trip passengers. It does not apply to cruises, where other services are included (according to European law, a cruise is considered as a sea transport service, operated exclusively for the purposes of pleasure, supplement-ed by accommodation and other facilities, with passengers spending a minimum of two nights on board).
If you arrive at the port of destination with more than 90 minutes delay, you have the right to compensation consisting of a percentage of the ticket price, under Article 19 of European regulation No 1177/2010.
In the event of cancellation, if you want to continue your journey, you have the right to demand to be rerouted to your final destination without any additional charges, under similar conditions and as soon as possible.
